1. Acceptance of Terms
By accessing or using the HuddleBoard Sports website, web application, iOS mobile app, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of a school, district, or organization, you represent that you have the authority to bind that entity. If you do not agree, do not use our Services.
2. Description of Services
HuddleBoard Sports provides an athletic program management platform for K-12 schools, school districts, and colleges. The platform includes:
- Athlete registration and onboarding workflows.
- Eligibility tracking and compliance management.
- Team and roster management.
- In-platform messaging and notifications for coaches, athletes, parents, and administrators.
- Team calendars with event management and external calendar sync.
- FERPA-compliant document management and medical form submissions.
- Equipment inventory tracking and checkout management.
- Athlete evaluations and assessments.
- Email template management.
- iOS mobile application for coaches.
- Administrative tools including audit logging, user management, and support ticketing.
3. Account Registration & Roles
Access to the platform requires an account. Accounts may be provisioned by a school or district administrator. Users are assigned roles (e.g., system administrator, school administrator, athletic director, coach, parent/guardian) that determine their level of access.
- You must provide accurate and complete registration information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must immediately notify us of any unauthorized use of your account.
- Administrators are responsible for managing user access within their organization, including onboarding and deactivating users.
4. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:
- Use the Services to store, transmit, or distribute content that violates any law or regulation.
- Attempt to gain unauthorized access to any part of the Services, other user accounts, or systems.
- Use the messaging or notification features for spam, harassment, or unsolicited communications.
- Share login credentials or allow unauthorized persons to access the platform.
- Reverse-engineer, decompile, or disassemble any part of the Services.
- Upload malicious files or code through the document management system.
- Access or disclose student records in violation of FERPA or other applicable privacy laws.
5. Student Data & FERPA
HuddleBoard Sports processes student educational records on behalf of schools and districts as a "school official" with a "legitimate educational interest" under FERPA (20 U.S.C. § 1232g).
- School ownership: Schools and districts retain full ownership of all student data entered into the platform.
- Purpose limitation: We use student data solely to provide the contracted athletic management services.
- No re-disclosure: We do not disclose student PII to third parties except as necessary to provide the Services or as required by law.
- Audit compliance: The platform maintains audit logs of data access and administrative actions to support institutional compliance obligations.
- Data return & deletion: Upon termination, schools may export their data. All student records are permanently deleted within 90 days after the data export period ends.
6. COPPA Compliance
When the Services are used by schools for students under 13 years of age:
- The school or district acts as the agent of the parent and provides consent for the collection of student information pursuant to COPPA's school consent exception.
- Schools are responsible for providing parental notification as required by COPPA.
- We collect only the minimum information necessary to provide the athletic management services.
- We do not use children's personal information for commercial purposes unrelated to the educational services, including targeted advertising.
- Parents may contact their school administrator or email privacy@huddleboardsports.com to review, correct, or delete their child's information.
7. Subscription Plans & Payment
The Services are offered under tiered subscription plans (Free, Starter, Pro, and Enterprise). Plan details, pricing, and included features are described on our Pricing page.
- Paid subscriptions are billed monthly or annually, in advance.
- You may upgrade or downgrade your plan at any time; changes take effect at the next billing cycle.
- We reserve the right to modify pricing with 30 days' notice to existing subscribers.
- Failure to pay may result in suspension or termination of access to paid features.
8. Refunds & Cancellations
HuddleBoard Sports provides digital subscription services. Subscriptions are billed in advance on a monthly or annual basis and may be canceled at any time from your account settings; access continues through the end of the current billing period.
Because the Services are delivered electronically and made available immediately upon subscription, all fees are non-refundable, including for partial billing periods, unused features, or accounts canceled mid-cycle. We may, at our sole discretion, provide prorated credits or refunds for documented extended service outages.
No physical goods are shipped. There is no return process because no tangible product is delivered.
9. Intellectual Property
All content, software, trademarks, logos, and intellectual property comprising the HuddleBoard Sports platform are owned by HuddleBoard Sports and protected by applicable intellectual property laws. You may not use our intellectual property without prior written consent.
You retain ownership of all content and data you upload to the platform. By using the Services, you grant us a limited, non-exclusive license to process your content solely as necessary to provide the Services.
10. API Access
API access is available on the Enterprise plan. Use of the API is subject to these Terms and any additional API documentation and rate limits we publish. We reserve the right to throttle or suspend API access for misuse or excessive usage.
11. Service Availability & Support
We strive to maintain high availability of the Services but do not guarantee uninterrupted access. Scheduled maintenance windows will be communicated in advance when possible.
Support response times vary by plan: email support within 48 hours (Starter), priority support within 24 hours (Pro), and same-day support (Enterprise).
12. Limitation of Liability
To the maximum extent permitted by law, HuddleBoard Sports shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or related to your use of the Services.
Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
14. Indemnification
You agree to indemnify and hold harmless HuddleBoard Sports and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
15. Termination
Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your access immediately if you violate these Terms or engage in conduct that threatens the security or integrity of the Services.
Upon termination, your right to use the Services ceases. Data export and deletion procedures are described in our Privacy Policy.
16. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email to account holders at least 30 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
